Biden Administration’s New Family Unity Policy: A Comprehensive Overview

The Department of Homeland Security (DHS) has introduced a new policy to enhance family unity within the U.S. immigration system. This policy focuses on noncitizen spouses of U.S. citizens who have resided continuously in the U.S. for at least 10 years. Eligible individuals must have no disqualifying criminal history, pose no security threat, and be otherwise eligible for status adjustment. This process allows qualifying individuals to apply for lawful permanent residence without leaving the U.S. The policy aims to assist approximately 500,000 spouses and 50,000 children.

Key Points:

• Continuous U.S. residence for 10+ years

• Legally valid marriage to a U.S. citizen

• No disqualifying criminal history

• National security and public safety considerations

• Application and fees detailed in a forthcoming Federal Register Notice

TL;DR:

DHS’s new policy helps noncitizen spouses and children of U.S. citizens apply for lawful permanent residence without leaving the U.S., promoting family unity and stability.
